Terms of Service

1. About these terms

These Terms of Service ("Terms") are an agreement between you and 404 Development ("404 Development", "we", "us" or "our"). They govern your access to and use of our websites, software, communities and related services, including 404development.com, GTAPoliceMods, FivePD and GPM Studio (together, the "Services").

By creating an account, downloading, installing or otherwise using any of the Services, you agree to these Terms. If you do not agree, do not use the Services. If you use the Services on behalf of a group, community or organization (for example, a FiveM server or roleplay community), you confirm that you have authority to accept these Terms on its behalf.

Some Services have additional rules, guidelines or license terms that are shown where they apply. Those additional terms form part of these Terms. If they conflict with these Terms, the additional terms win for that Service.

2. Our services

404 Development operates the following Services:

• 404development.com: our company website, which provides information about us and our projects.
• GTAPoliceMods: a community website where users share, discover and discuss law-enforcement modifications for Grand Theft Auto V and FiveM, including vehicles, liveries, EUP, scripts and other resources, along with forums and related community features.
• FivePD: a police roleplay framework for FiveM servers, including the software, its documentation, add-ons and any related downloads, licenses or support.
• GPM Studio: a creator platform from the GTAPoliceMods team. Features and availability will be announced as it is released, and any additional terms will be provided at that time.

We may add, change, suspend or remove features of any Service at any time. We will try to give reasonable notice of significant changes where we can.

3. Eligibility

You must be at least 13 years old to use the Services, or the minimum age required in your country if that is higher. If you are under the age of majority where you live, you may only use the Services with the permission of a parent or legal guardian, who agrees to these Terms on your behalf.

You may not use the Services if you have previously been banned from them, or if you are prohibited from receiving them under applicable law.

4. Accounts

Some features require an account. When you create one, you agree to give accurate information and to keep it up to date. You are responsible for keeping your login details secure and for all activity that happens under your account.

• Do not share your account, sell it or let anyone else use it.
• Do not create accounts by automated means or to get around a ban or restriction.
• Tell us promptly if you believe your account has been accessed without your permission.

Where we let you sign in with a third-party service (such as Discord), your use of that service is also subject to its own terms.

5. Acceptable use

You agree not to use the Services to:

• Break any law or encourage anyone else to do so.
• Harass, threaten, bully, impersonate or discriminate against anyone.
• Post content that is hateful, sexually explicit, violent in a real-world sense, or otherwise objectionable under our community rules.
• Upload or share content you do not have the rights to, including other creators' mods, models, textures or code without their permission.
• Distribute malware, cheats, exploits, or files that are misleading about what they do.
• Spam, run unauthorized advertising, or manipulate ratings, downloads or reviews.
• Scrape, crawl or bulk-download the Services without our written permission.
• Attempt to disrupt, overload, reverse engineer (except where the law allows), or gain unauthorized access to the Services or their systems.
• Get around any access restriction, license check, rate limit or ban.

Each community may also publish its own rules. You must follow those rules when taking part in that community.

6. Your content

"Your Content" means anything you upload, post or submit through the Services, such as mods, files, images, videos, descriptions, comments, reviews and forum posts.

You keep ownership. You keep any rights you have in Your Content. By posting it, you give 404 Development a worldwide, non-exclusive, royalty-free license to host, store, copy, display, distribute, adapt (for example, to create thumbnails or previews) and make Your Content available through the Services and in promoting the Services. This license lasts for as long as Your Content is on the Services, plus a reasonable period afterwards for backups and caches to clear.

You are responsible for it. You confirm that you own Your Content or have all the permissions needed to share it, and that it follows these Terms. Where Your Content is based on someone else's work, you must have their permission and give credit where required.

Moderation. We are not required to review content, but we may remove, hide or restrict any content, at any time and for any reason, including if we believe it breaks these Terms or the law.

7. GTAPoliceMods

Uploading files. When you upload a file to GTAPoliceMods, you choose how others may use it, within the options the site offers. Downloaders must respect the permissions the author has set. If no permissions are stated, you may only use the file for personal use and may not re-upload, sell or redistribute it.

Downloading files. Files on GTAPoliceMods are created by community members, not by 404 Development, unless clearly marked otherwise. We do not guarantee that any file is safe, works correctly, or is compatible with your game, server or other mods. Always keep backups and install mods at your own risk.

Scans and checks. We may scan uploaded files for malware or rule violations, but a file passing a scan is not a promise that it is safe.

Forums and community features. Posts, comments and reviews are Your Content and must follow the acceptable use rules above. Reviews must reflect your honest experience.

8. FivePD

License. Subject to these Terms and any license you have obtained, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use FivePD on FiveM servers you own or operate. FivePD is licensed, not sold. We keep all rights not expressly granted to you.

Restrictions. Unless we give written permission, you may not:

• Resell, sublicense, rent or redistribute FivePD or any part of it.
• Share license keys, or use one license on more servers than it allows.
• Remove or bypass licensing, attribution or copyright notices.
• Publish modified versions of FivePD's core files.

Add-ons and callouts. You may create and share add-ons, callouts and plugins that work with FivePD using its public interfaces. You own your add-ons, but they must not include FivePD's own code or assets, and they must not suggest they are official unless we have approved them.

Server operators. If you run FivePD on a server, you are responsible for your server, its community and how you configure the software, including following FiveM's and Cfx.re's own terms. We are not responsible for the conduct of players on your server.

Updates and support. We may release updates that change or remove features. Some updates may be required to keep using FivePD. Support is provided on a best-effort basis unless a specific support level is included with your license.

9. GPM Studio

GPM Studio is in development. Access may be offered as a preview, beta or early-access release. Pre-release versions may be unstable, change significantly, lose data or be withdrawn without notice, and are provided for testing and feedback.

If you give us feedback or suggestions about GPM Studio or any other Service, you allow us to use them freely, without any obligation to you.

Content you create or publish with GPM Studio is Your Content and is covered by section 6. Additional terms specific to GPM Studio will be published before or at its release, and will apply alongside these Terms.

10. Purchases and payments

Some Services may offer paid features, such as FivePD licenses, memberships, subscriptions, upgrades or premium content. When you buy something from us:

• The price, what is included and any usage limits will be shown before you pay.
• Payments are handled by third-party payment processors, whose terms also apply. We do not store your full card details.
• Subscriptions renew automatically until you cancel. You can cancel at any time, and the cancellation takes effect at the end of the current billing period.
• Prices may change. Any change to a subscription price applies from your next renewal, and we will tell you in advance.
• Digital licenses and downloads are generally non-refundable once delivered or activated, except where required by law or stated otherwise at the time of purchase.
• Chargebacks or fraudulent payments may lead to the related license or account being suspended.

If you are a consumer, nothing in these Terms takes away any rights you have under consumer protection laws where you live.

11. Our intellectual property

The Services, including their software, design, text, graphics, logos and the names 404 Development, GTAPoliceMods, FivePD and GPM Studio, belong to 404 Development or its licensors and are protected by intellectual property laws. Apart from the rights expressly given in these Terms, you may not copy, modify, distribute, sell or use them without our written permission.

You may refer to our projects by name, for example to say that your server uses FivePD or that your mod is available on GTAPoliceMods, as long as you do not suggest we endorse you.

12. Copyright complaints

We respect the rights of creators. If you believe content on the Services infringes your copyright or other rights, send a notice to hello@404development.com that includes:

• Your name and contact details.
• A description of the work you believe is being infringed.
• A link to, or clear description of, the content you want removed.
• A statement that you believe in good faith that the use is not authorized.
• A statement that the information in your notice is accurate and that you own, or are authorized to act for the owner of, the rights involved.
• Your physical or electronic signature.

We may remove the content and notify the user who posted it. Users who repeatedly infringe others' rights may have their accounts terminated. If you believe your content was removed by mistake, you may send a counter-notice to the same address.

13. Third-party games and services

Our Services relate to games and platforms owned by other companies. Grand Theft Auto and GTA are trademarks of Take-Two Interactive Software, Inc. FiveM and Cfx.re are owned by their respective owners. 404 Development is not affiliated with, endorsed by or sponsored by Take-Two Interactive, Rockstar Games or Cfx.re.

Your use of those games and platforms is governed by their own terms. Using mods may break the rules of some games or online services, particularly in official online modes. You are responsible for making sure your use of mods and the Services follows those rules.

The Services may link to third-party websites, tools or downloads. We are not responsible for them, and you use them at your own risk.

14. Suspension and termination

You may stop using the Services at any time, and you can ask us to delete your account.

We may suspend or terminate your access to any or all Services, remove your content, or revoke any license, if we reasonably believe you have broken these Terms, created risk or possible legal exposure for us or others, or if we are required to by law. Where reasonable, we will tell you why. If we end a paid license without cause, we will offer a fair refund for any unused prepaid period.

Sections that by their nature should continue after termination, such as those about content licenses, intellectual property, disclaimers, liability and disputes, will continue to apply.

15. Disclaimers

The Services, and all content and files available through them, are provided "as is" and "as available". To the fullest extent permitted by law, we make no warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Services will be uninterrupted, secure or error-free.

We are not responsible for user-created content or files, including any damage they may cause to your game installation, server, computer or data.

16. Limitation of liability

To the fullest extent permitted by law, 404 Development and its team will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, goodwill or game progress, arising from or related to your use of the Services.

Our total liability for any claim related to the Services is limited to the greater of (a) the amount you paid us for the relevant Service in the 12 months before the claim, or (b) USD $50.

Some places do not allow certain limitations of liability, so some of these limits may not apply to you.

17. Indemnity

You agree to defend and compensate 404 Development and its team against any claims, losses and costs (including reasonable legal fees) that arise from Your Content, your use of the Services, or your breach of these Terms or the rights of others, to the extent permitted by law.

18. Governing law and disputes

These Terms are governed by the laws of [Jurisdiction], without regard to its conflict of law rules. Any dispute will be handled in the courts located in [Jurisdiction], unless the law where you live gives you the right to bring a claim locally.

Before starting any formal claim, please contact us first so we can try to resolve the issue informally.

19. Changes to these terms

We may update these Terms from time to time. The date at the top shows when they last changed. If a change is significant, we will give notice, for example on our websites or by email. Continuing to use the Services after the change means you accept the updated Terms.

If any part of these Terms is found unenforceable, the rest will still apply. If we do not enforce a part of these Terms, that does not mean we give up the right to enforce it later. These Terms, with any additional terms for specific Services, are the entire agreement between you and us about the Services.
